ERApix lets hosts and players upload photos to a gallery that is publicly viewable by anyone who has the gallery link. Galleries are intended to be not indexed by search engines, but anyone with the link may share it.

3) Information We Collect

Photos you upload (image content) and associated information you submit with them (if any).
Email address and/or phone number if you use our form to request that a gallery link be sent to you.

5) How We Share Information

Viewers may screenshot, download, or re-share photos outside the Service.

7) Children and Minors
The Service may be used by adults and minors. Minors must have permission from a parent or legal guardian to use the Service and upload photos.

If you upload photos of someone under 18, you represent that you have appropriate permission from the minor’s parent or guardian (or other legal authority) to upload and share that image as described by the Service.

8) Content Moderation and Removal Requests
Users may flag a photo for review. Users cannot remove photos themselves. We may remove photos that are flagged or otherwise violate our Terms of Service, our policies, or applicable law.

9) Data Retention
We retain information for as long as necessary to:

operate the Service (including maintaining galleries),
address reports and disputes,

Because galleries are link-accessible, we may keep photos until they are removed through moderation, a legal request, or operational retention practices.

10) Security
We use reasonable administrative, technical, and physical safeguards designed to protect information. However, no method of transmission or storage is 100% secure.

11) Your Choices
Depending on how the Service is implemented, you may be able to:

Control cookies via browser/device settings.

4) User Content (Photos) and Your Responsibilities
You are solely responsible for any photos you upload (“User Content”) and the consequences of sharing it.

You represent and warrant that:

You own the User Content or have all rights and permissions needed to upload it and grant the licenses in these Terms.
Your User Content does not violate any law or infringe any third-party rights (including copyright, trademark, privacy, or publicity rights).
If your User Content includes minors, you have appropriate permission from a parent or legal guardian (or other legal authority) to upload and share it.

7) License You Grant to ERAtainment (Including Marketing)
By uploading User Content, you grant ERAtainment a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

host, store, reproduce, modify (for technical purposes such as formatting), display, publish, and distribute your User Content
for the purposes of operating, providing, improving, and promoting the Service and ERAtainment, including marketing, advertising, and social media.
You understand that this means we may use uploaded photos in promotional materials (online or offline) without compensation to you.

8) Intellectual Property; Our Rights
The Service and its underlying technology, design, and branding are owned by ERAtainment or its licensors and are protected by applicable laws. Except for the rights explicitly granted in these Terms, we reserve all rights.

9) Copyright / DMCA Policy (Notice and Takedown)
If you believe content on the Service infringes your copyright, you may send a notice to: info@eratainment.games

Your notice should include:

Identification of the copyrighted work claimed to be infringed.
Identification of the material you claim is infringing (include the gallery link and enough detail to locate it).
Your contact information.

10) Text Messages (SMS) / Email Link Delivery
If you request that we send a gallery link via text message or email:

You authorize us to send messages to the number/email you provide for this purpose.
Message and data rates may apply depending on your carrier/plan.
Delivery is not guaranteed (e.g., carrier filtering, outages).
We are not responsible for messages sent to an incorrect number/email you provided.

11) Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERATAINMENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERATAINMENT AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR USER CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERATAINMENT’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED $100 USD.

13) Indemnification
You agree to defend, indemnify, and hold harmless ERAtainment from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

your use of the Service,
your violation of these Terms, or
your violation of any rights of another (including privacy/publicity and intellectual property).
14) Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It affects your rights.

A. Informal resolution
Before filing a claim, you agree to contact us at info@eratainment.games and provide a brief description of the dispute and your requested relief. We’ll try to resolve it informally.

B. Binding arbitration
If informal resolution fails, you and ERAtainment agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

The arbitration will be conducted in English by a recognized arbitration administrator under its applicable rules.

C. Class action waiver
You and ERAtainment agree that disputes will be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

D. Opt-out
You may opt out of arbitration and the class action waiver by emailing info@eratainment.games within 30 days of first accepting these Terms, stating your name and that you want to opt out of arbitration/class waiver.

15) Governing Law; Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. If a dispute is permitted to proceed in court (e.g., small claims, injunctive relief, or if arbitration is unenforceable), you agree it will be brought in state or federal courts located in Florida, and you consent to personal jurisdiction there.

16) Changes to the Service or Terms
We may modify the Service or these Terms at any time. If we make changes, we will update the “Last Updated” date. Your continued use after changes means you accept the updated Terms.

17) Termination
We may suspend or terminate access to the Service at any time, with or without notice, if we believe you violated these Terms or if we determine it’s necessary to protect the Service, ERAtainment, or others.

18) Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

19) Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ERAtainment regarding the Service.
